What if an employee is eligible for FAMLI but not FMLA, they take the 12 weeks under FAMLI and then return to work and have a new need for leave within that same year at which time they now qualify for FMLA, will they now get an additional 12 weeks under FMLA? Even though they already received 12 weeks under FAMLI within that same 12 month period?
